These Terms and Conditions govern the use of services and equipment provided by TimberTails Services LLC (“Company”, “we”, “us”, or “our”). By renting equipment or using our services, you (“Customer”, “Renter”, or “you”) agree to the following terms:
1. Equipment Rentals
We offer short-term rentals of outdoor equipment, including but not limited to wood chippers, splitters, and trailers. All rentals are subject to availability and must be scheduled and confirmed in advance.
2. Rental Periods
Rental periods are offered as either:
- 1 Day Rental, or
- 3 Day Rental
The rental begins on the agreed date and ends by 6:00 PM on the final day. Equipment must be returned by that time to avoid late fees unless prior written approval is granted.
3. Fees and Payments
- Rental fees vary by equipment and duration.
- A security deposit is required and will be refunded upon the safe and timely return of the equipment, subject to inspection.
- A delivery fee begins at $30 and may vary by location.
- Full payment is due at the time of rental unless otherwise agreed in writing.
- Late returns are subject to a late fee, which may be deducted from the security deposit.
4. Equipment Use & Responsibilities
By renting from TimberTails Services LLC, you agree:
- To operate equipment safely and responsibly, following all provided instructions.
- To not modify, repair, or tamper with the equipment.
- To return equipment clean and in good condition, with normal wear and tear excepted.
- That you are liable for any damage, theft, or misuse during the rental period.
- That the rented equipment will only be used for legal purposes and not on unauthorized property.
5. Operator Services
Operator services (equipment use by our team) are available upon request for an additional hourly fee. The Customer is responsible for ensuring that the service site is accessible, safe, and hazard-free.
6. Cancellations & Refunds
- Cancellations made more than 24 hours before the rental period may qualify for a full refund.
- Cancellations made within 24 hours of the rental period may result in a partial refund or no refund depending on the circumstances and scheduling constraints.
7. Identification Requirement
A valid government-issued photo ID is required at the time of rental. A copy of the ID may be retained for the duration of the rental and securely destroyed upon return of equipment.
8. Liability Waiver
The Company is not responsible for injuries, damages, or property loss resulting from the use of rented equipment. By renting from us, you acknowledge the risks and agree to use the equipment at your own risk.
You agree to indemnify and hold harmless TimberTails Services LLC, its owners, and employees from any and all claims, liabilities, or legal actions arising out of your use of the equipment or services.
9. Governing Law
These Terms and Conditions are governed by the laws of the State of Michigan. Any legal disputes will be resolved in the appropriate Michigan courts.
10. Modifications
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted to our website and become effective immediately.
